1. Introduction and Acceptance
1.1 Service Provider
Paper Chase (“the Service”, “the Platform”, “we”, “us”, “our”) is operated by Cyber Beaver Studio Kamil Dutka, with registered address at ul. Dolnych Mlynow 3/1, 31-124 Krakow, Poland, registered under NIP: 9452244194 (“the Operator”).
1.2 Agreement
These Terms of Service (“Terms”, “ToS”) constitute a legally binding agreement between you (“User”, “you”, “your”) and the Operator, governing your access to and use of the Paper Chase mobile application and related services.
By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.
1.3 Definitions
- Badge – A location-based collectible item within the Service, associated with a specific geographic location.
- Game – An organized set of Badges forming a thematic route or challenge.
- User Content – Any content submitted by Users, including photos, ratings, comments, and reactions.
- Location Verification – The process of confirming a User’s physical presence at a Badge location using GPS data.
2. Eligibility and Accounts
2.1 Age Requirements
You must be at least 16 years old to use the Service. Users aged 13 to 15 may use the Service only with verifiable parental or legal guardian consent. Users under 13 are not permitted to use the Service under any circumstances.
The age requirement of 16 aligns with the Polish implementation of the General Data Protection Regulation (Regulation (EU) 2016/679, “GDPR” / “RODO”), which sets the age of digital consent at 16 years.
2.2 Account Creation
To access certain features of the Service, you must create an account. You may register using:
- Email address with one-time password (OTP) verification
- Third-party authentication (Google, Apple, or Facebook)
- Anonymous mode (limited functionality)
2.3 Account Responsibilities
You are responsible for:
- Providing accurate and current registration information.
- Maintaining the confidentiality of your account credentials.
- All activities that occur under your account.
- Notifying us immediately of any unauthorized use of your account.
2.4 One Account Per User
Each person may maintain only one active account. Creating multiple accounts to circumvent restrictions, manipulate leaderboards, or gain unfair advantages is prohibited.
3. Service Description
3.1 Overview
Paper Chase is a location-based gamification platform that enables Users to discover and collect Badges placed at real-world geographic locations. The Service includes:
- Badge Collection – Visiting physical locations to collect digital Badges via GPS verification.
- Games – Themed routes and challenges consisting of multiple Badges.
- Social Features – Activity feed, following other Users, comments, reactions, and ratings.
- Achievements – Rewards for reaching milestones and completing challenges.
- Leaderboards – Rankings based on collection progress and points.
3.2 Location-Based Nature
The core functionality of the Service requires access to your device’s GPS location. Without location access, Badge collection and Game participation are not possible.
3.3 Service Availability
We strive to provide uninterrupted access to the Service but do not guarantee availability. The Service may be temporarily unavailable due to maintenance, updates, server issues, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.
3.4 Offline Functionality
Certain features may be available in offline mode with limited functionality. Full Service features require an active internet connection.
3.5 Service Discontinuation
We may discontinue the Service entirely, at any time, for any reason, with or without notice. While we will make reasonable efforts to provide advance notice of a planned shutdown, we are under no obligation to do so. Discontinuation of the Service does not entitle you to any compensation, refund, or claim for damages. In the event of discontinuation, we will honor our data protection obligations as described in our Privacy Policy.
4. License to Use
4.1 Grant of License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Paper Chase application on a compatible mobile device that you own or control, solely for personal, non-commercial purposes.
4.2 Restrictions
You may not:
- Copy, modify, distribute, sell, or lease any part of the Service.
- Reverse engineer, decompile, or disassemble the application.
- Use the Service for any commercial purpose without our prior written consent.
- Remove, alter, or obscure any proprietary notices or labels.
- Use automated systems, bots, or scripts to interact with the Service.
5. User Conduct
5.1 General Rules
You agree to use the Service in compliance with all applicable laws and regulations. You must not use the Service in any manner that could damage, disable, or impair the Service or interfere with other Users’ experience.
5.2 Prohibited Activities
The following activities are strictly prohibited:
Location Manipulation
- GPS Spoofing – Using software, hardware, or any other means to falsify your geographic location.
- Location Emulation – Using emulators, VPNs, or proxy services to simulate being at a location you are not physically present at.
- Remote Collection – Collecting Badges without being physically present at the designated location.
Cheating and Exploitation
- Exploiting bugs, glitches, or vulnerabilities in the Service.
- Using third-party tools, modified applications, or unauthorized clients.
- Manipulating leaderboards, scores, or statistics through illegitimate means.
- Sharing account credentials to allow others to collect Badges on your behalf.
Harmful Behavior
- Harassment, bullying, threats, or intimidation of other Users.
- Posting offensive, defamatory, discriminatory, or illegal content.
- Impersonating other Users, the Operator, or any third party.
- Spamming, advertising, or soliciting without authorization.
- Submitting false issue reports or abuse complaints.
5.3 Enforcement
We reserve the right to investigate and take action against violations, including but not limited to issuing warnings, suspending or terminating accounts, removing content, and reporting illegal activities to law enforcement.
5.4 Blocking and Muting
You may block or mute other Users at any time through the application. Blocking a User prevents them from viewing your profile, activity, and content, and automatically removes any mutual follow relationships. Muting a User hides their content from your feed without notifying them. These tools are provided for your safety and comfort and do not require a reason.
6. User-Generated Content
6.1 Content You Submit
You may submit content through the Service, including profile information (username, display name, bio, avatar), photos taken at Badge locations, ratings and reviews of Badges, comments and reactions on activity feed items.
6.2 License Grant
By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, display, and distribute such content in connection with operating and promoting the Service. This license persists for the duration your content remains on the Platform and for a reasonable period thereafter necessary for backup and archival purposes.
6.3 Content Responsibilities
You represent and warrant that:
- You own or have the necessary rights to submit the content.
- Your content does not infringe any third party’s intellectual property or other rights.
- Your content does not violate any applicable law or regulation.
- Your content does not contain malicious code, viruses, or harmful material.
6.4 Content Moderation
We employ a combination of automated and human moderation to maintain a safe environment.
Automated Pre-Submission Filtering. User-submitted text content (including comments, ratings, usernames, and display names) is checked against a rule-based keyword filter before publication. The filter operates across multiple languages and applies two strictness tiers: a standard tier for general user-generated content and a stricter tier for usernames and display names. Content that matches the filter is rejected at the time of submission and is not published. Individual rejections do not result in account-level consequences.
Post-Submission Moderation. Content that has been published may be reviewed and removed by our moderation team following user reports (see Section 6.5) or internal review. Post-submission removal decisions are made by human moderators.
Enforcement Ladder. Repeated or serious violations of these Terms may result in escalating enforcement actions:
- Warning – A notification informing you of the violation.
- Content Removal – Removal of the offending content with a notification explaining the reason.
- Account Suspension – Temporary restriction of your account for a defined period.
- Account Ban – Permanent termination of your account.
The specific action taken depends on the severity and frequency of violations. All enforcement decisions are accompanied by a statement of reasons, including the specific rule violated and whether the decision was made through automated means or by a human moderator.
Appeals. If you believe an enforcement action was made in error, you may appeal by contacting us at contact@paperchase.app within 30 calendar days of the decision. We will review your appeal and respond within a reasonable timeframe.
6.5 Content Reporting
We provide mechanisms for reporting content that you believe is illegal or violates these Terms:
- In-App Reporting – Authenticated Users may report content directly through the application using the reporting feature available on comments, ratings, and user profiles.
- Email Reporting – Any person, including non-users, may report potentially illegal content by emailing report@paperchase.app. Please include a description of the content, its location within the Service (if known), and an explanation of why you believe it is illegal.
Upon receiving a report, we will:
- Acknowledge receipt of the report.
- Investigate the reported content in a timely, diligent, and non-arbitrary manner.
- Notify the reporter of our decision and the reasons for it.
Where content is found to be illegal, we will remove or disable access to it promptly.
7. Location-Based Activity Safety
7.1 Real-World Risk Acknowledgment
Paper Chase involves physical movement to real-world locations. By using the Service, you acknowledge and accept the inherent risks associated with location-based activities.
You understand that:
- Badge locations may be situated in areas with varying terrain, accessibility, and safety conditions.
- Weather, traffic, and environmental conditions may affect the safety of visiting certain locations.
- Not all locations may be accessible or safe at all times of day or year.
- GPS accuracy varies and may lead you to approximate rather than exact locations.
7.2 Safety Guidelines
When using the Service, you must:
- Always be aware of your surroundings. Do not use the application while driving, cycling, or operating any vehicle or machinery.
- Respect private property. Do not trespass on private land to collect Badges. If a Badge appears to be on private property, do not attempt to access it.
- Follow local laws. Obey all traffic rules, signage, and local regulations.
- Prioritize personal safety. If a location feels unsafe, do not attempt to collect the Badge. No Badge is worth risking your safety.
- Be considerate. Respect the environment, other people, and the communities you visit.
7.3 No Driving While Using the App
You must never use the Paper Chase application while driving or operating a vehicle. If you are a passenger, ensure the driver is not distracted by the application.
7.4 Disclaimer of Location Safety
The Operator does not inspect, verify the safety of, or control access to physical locations associated with Badges. Badge placement does not imply that a location is safe, accessible, or appropriate for visitation. You visit all locations at your own risk and discretion.
7.5 Health and Physical Fitness
The Service involves physical activity, including walking, hiking, and outdoor movement. You are solely responsible for assessing your own physical fitness and health condition before engaging in location-based activities. If you have any medical condition that may be affected by physical exertion, consult a qualified medical professional before using the Service. The Operator is not responsible for any health-related consequences arising from your use of the Service.
8. Intellectual Property
8.1 Platform Ownership
The Service, including its design, code, graphics, logos, trademarks, Badge content, Game designs, and all other proprietary materials, is owned by the Operator or its licensors. All rights not expressly granted in these Terms are reserved.
8.2 User Content Ownership
You retain ownership of the User Content you submit. The license granted in Section 6.2 does not transfer ownership of your content to us.
8.3 Copyright Complaints
If you believe that content on the Service infringes your copyright, please contact us at the address provided in Section 15 with a detailed description of the alleged infringement.
9. Account Termination
9.1 Termination by You
You may request account deletion at any time through the application’s account settings (Settings → Account → Delete Account). The deletion process works as follows:
- Immediate Deactivation. Upon submitting a deletion request, your account is immediately deactivated. Your profile, content, and activity become invisible to other Users.
- 30-Day Grace Period. Your data is retained for 30 days from the deletion request. During this period, you may cancel the deletion by logging back into your account, which restores your profile and data from a snapshot taken at the time of the request.
- Permanent Deletion. After the 30-day grace period, your personal data, gameplay data, and social connections are permanently deleted. User Content you submitted (such as comments and ratings) is anonymized – disassociated from your identity but retained to preserve the integrity of community content.
- Email Confirmations. You will receive email confirmations at each stage: upon requesting deletion, reminder notifications during the grace period, and a final confirmation upon completion of deletion.
9.2 Termination by Us
We may suspend or terminate your account in accordance with the enforcement ladder described in Section 6.4. Grounds for enforcement action include:
- Violation of these Terms, including prohibited activities described in Section 5.
- Repeated content moderation violations.
- Legal or regulatory requirements.
All enforcement decisions are accompanied by a statement of reasons, as described in Section 6.4.
9.3 Consequences of Termination
Upon termination (whether by you or by us):
- Your license to use the Service is immediately revoked.
- Your access to your account and associated data is removed.
- Any in-progress Games or uncollected Badges are forfeited.
- Anonymized User Content (comments, ratings) may be retained as described in Section 9.1.
- Moderation action records and legal consent records are retained as required by law (see our Privacy Policy for retention periods).
- Provisions that by their nature should survive termination (including Sections 6.2, 7, 8, 10, 11, 12, and 14) shall remain in effect.
10. Limitation of Liability
10.1 Service Provided “As Is”
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10.2 No Guarantee
We do not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free.
- GPS-based location verification will be accurate.
- Badge locations will be safe, accessible, or appropriate.
- The results obtained from using the Service will be accurate or reliable.
10.3 Limitation of Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, PERSONAL INJURY, OR PROPERTY DAMAGE ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
10.4 EU Consumer Rights
Nothing in these Terms shall limit or exclude liability that cannot be limited or excluded under applicable law, including under Directive 2011/83/EU on consumer rights and the Polish Consumer Rights Act (Ustawa z dnia 30 maja 2014 r. o prawach konsumenta). In particular, nothing in these Terms limits the Operator’s liability for:
- Death or personal injury caused by negligence.
- Fraud or fraudulent misrepresentation.
- Any liability that cannot be excluded or limited by Polish law or EU law.
10.5 Third-Party Services
The Service relies on third-party services including, but not limited to, mapping providers, authentication providers, hosting services, and email delivery services. We do not control and are not liable for the accuracy, availability, or performance of these third-party services. In particular, map data and location information provided by third parties may contain inaccuracies. Any reliance on third-party services is at your own risk.
10.6 Maximum Liability
To the maximum extent permitted by applicable law, the Operator’s total aggregate liability to you for all claims arising out of or in connection with the Service or these Terms shall not exceed the total amount you have paid to the Operator for use of the Service in the twelve (12) months preceding the event giving rise to the claim. This limitation applies regardless of the legal theory on which the claim is based. This cap does not apply to liability that cannot be limited under Section 10.4.
10.7 Force Majeure
The Operator shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, internet or telecommunications failures, power outages, cyberattacks, pandemics, or the actions of third-party service providers.
11. Indemnification
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless the Operator, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:
- Your use of the Service.
- Your violation of these Terms.
- Your violation of any third party’s rights.
- Your User Content.
This indemnification obligation does not apply to the extent that the claim arises from the Operator’s own negligence, willful misconduct, or breach of these Terms.
12. Dispute Resolution
12.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of law principles. The following Polish legislation applies in particular:
- Kodeks Cywilny (Civil Code) – Ustawa z dnia 23 kwietnia 1964 r.
- Ustawa o prawach konsumenta (Consumer Rights Act) – Ustawa z dnia 30 maja 2014 r.
- Ustawa o swiadczeniu uslug droga elektroniczna (Electronic Services Act) – Ustawa z dnia 18 lipca 2002 r.
- Prawo autorskie (Copyright Law) – Ustawa z dnia 4 lutego 1994 r.
12.2 Jurisdiction
Any disputes arising from or relating to these Terms or the Service shall be submitted to the competent courts of the Republic of Poland.
12.3 EU Online Dispute Resolution
If you are an EU consumer, you may also use the European Commission’s Online Dispute Resolution (ODR) platform, available at https://ec.europa.eu/consumers/odr, to resolve disputes online.
12.4 Complaint Procedure
If you have a complaint regarding the Service:
- Submit your complaint via the contact details in Section 15.
- We will acknowledge receipt within 7 business days.
- We will investigate and respond within 14 business days from acknowledgment.
- If you are not satisfied with the resolution, you may pursue the remedies described in Sections 12.2 and 12.3.
13. Changes to Terms
13.1 Right to Modify
We reserve the right to modify these Terms at any time. Changes will be communicated through the application (e.g., an in-app notification or a prompt to accept updated Terms).
13.2 Notice
We will provide reasonable advance notice of material changes (at least 14 days before the new Terms take effect) unless the changes are required by law.
13.3 Acceptance of Changes
Continued use of the Service after the effective date of updated Terms constitutes your acceptance. If you do not agree to the revised Terms, you must stop using the Service and delete your account.
14. General Provisions
14.1 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
14.2 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Operator regarding your use of the Service. They supersede all prior agreements, representations, and understandings, whether written or oral.
14.3 No Waiver
The failure of the Operator to enforce any provision of these Terms shall not constitute a waiver of that provision or the right to enforce it at a later time.

Illegal Content Reporting. To report content you believe to be illegal, use the in-app reporting feature or email report@paperchase.app (see Section 6.5).
Moderation Appeals. To appeal a content moderation or enforcement decision, email contact@paperchase.app within 30 calendar days (see Section 6.4).
